For paid consultation services, payment terms will be specified in separate service agreements. All fees are quoted in Euros (EUR) unless otherwise specified. Payment is typically due within 30 days of invoice date. Late payments may incur additional charges. We reserve the right to suspend services for accounts with overdue payments.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR).
To the maximum extent permitted by applicable law, SolarNomad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount paid by you to SolarNomad in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
You agree to defend, indemnify, and hold harmless SolarNomad and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our services.
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Bergen, Norway, and you hereby consent to the personal jurisdiction and venue therein. For users within the European Union, these Terms comply with applicable EU consumer protection regulations.
We encourage users to contact us directly to resolve any disputes. If a dispute cannot be resolved through direct communication, it may be submitted to mediation before pursuing formal legal proceedings. EU consumers have the right to use the European Commission's Online Dispute Resolution platform.
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use our services will cease immediately. If you wish to terminate your account, you may simply discontinue using our services. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
SolarNomad shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and SolarNomad concerning our services and supersede all prior or contemporaneous communications and proposals.
